Overview

The Australian Partner Visa allows the spouse or de facto partner of an Australian citizen, permanent resident, or eligible New Zealand citizen to live in Australia. The visa is typically granted in two stages: a temporary visa followed by a permanent visa.

 

Types of Partner Visas

  1. Temporary Partner Visa (Subclass 820/309) – Allows the applicant to stay in Australia while the permanent visa is being processed.
  2. Permanent Partner Visa (Subclass 801/100) – Granted after the applicant has met the requirements for a permanent stay.

 

Eligibility Criteria

To be eligible for a Partner Visa, the applicant must:

  • Be in a genuine and continuing relationship with an Australian citizen, permanent resident, or eligible New Zealand citizen.
  • Be married or in a de facto relationship for at least 12 months (unless exceptions apply).
  • Meet health and character requirements.
  • Provide evidence of a committed and exclusive relationship.

 

Application Process

  1. Lodge the Application – The application for both the temporary and permanent visa is lodged together.
  2. Provide Supporting Documents – Evidence of relationship, financial commitment, social recognition, and cohabitation must be submitted.
  3. Health and Character Checks – Undergo medical examinations and provide police clearance certificates.
  4. Processing Time – Temporary visa processing times vary; once granted, the applicant can stay in Australia until the permanent visa is assessed.
  5. Permanent Visa Grant – Generally granted two years after the initial application, provided the relationship is still ongoing.
